Need information - considering lawsuit against Ford

I've put a lot of information in my previous post about my 2022 Powerboost dying outside Moab almost 60 days ago. It finally got diagnosed to a bad in-tank fuel pump which is on nationwide backorder (Ford says) and is part number PL3Z9H307B. It has less than 16k miles.

I've been told that is the same fuel pump that would be used in any 2022/2023 F150 with the 3.5 V-6 engine (not just the Powerboost). So if Ford has produced any of these in the last 60 days that would mean the factory has the part, and just won't release any to dealers.

If I can verify it is the same part and the factory has them, I am considering filing suit.

Hopefully some of you can help me with these details, thanks

Lawsuit won't get you anywhere.

Dealer would probably have better luck ordering the full gas tank from Ford with the pump included.

Take a look at this summary of Indiana’s Lemon Law from the Indiana AG’s office. https://www.in.gov/attorneygeneral/consumer-protection-division/files/Lemon_Law.pdf. If you qualify for protection, this might be a viable course of action. Although you might not prefer the remedy (return and refund or replacement), the threat of a Lemon Law action might be enough of an incentive to get corporate to pay attention and get you the part you need. It would be far cheaper for Ford.

Thanks, I have told customer care to get the buyback program underway. I don't really want to order and buy a new truck, but will see what they offer.

I still think they need to be punished if they withhold parts and claim unavailability. The lawsuit wouldn't be to get my truck fixed, it would be to sue them for their business practices.

“Punishment” is a tough row to hoe in civil actions. You’d need to establish intentional or tortious conduct.

You are probably aware of this, but telling "customer care to get the buyback program underway" and filing a Lemon Law claim are not the same.

@Ford Motor Company won't do a darn thing except compliment photos of new trucks.

Yes, Ford builds vehicles every day with parts that are on national backorder, customer be damned.

They don't care and they never will, as long as we continue to buy their products.

If you're considering a lawsuit, I wouldn't start here - in a public forum. Leave the lawyering to lawyers.

The issues you've experienced are very shitty and unfortunate, and I do hope you see satisfactory resolution soon.

I could be wrong but aren't we only allowed to go into arbitration and not able to actually sue Ford for defective vehicles/parts? There may be a way around arbitration especially with a knowledgeable lawyer but it can be difficult to do.

look up for the part in your local wrecker and have the dealership pay for it and install it and have them install a new one once it becomes available. I can look up the part for you in my local wrecker if you provide me with the part number.

Sorry to unveil Oz behind the curtain, but it's a bot (or an intern at best).

IF @Ford actually does put a capable human in touch with a customer, their experience will vary, solely based on whether or not their dealer is a slimeball. This is not unique to Ford. All of the OEM's insulate themselves very well from their dealers/purchase/service experience. I buy A LOT of new vehicles and have heard everything from "Don't file a Lemon Law case, we will just buy it back (from a good dealer)" to "If you don't like it, call GM* (bad dealer)".

*GM answers: "You need to call your dealer"
Me: "My dealer sucks and told me to call you"
GM: " I just sent you a list of other dealers. Have a nice day"

Good dealer=Good Experience
Bad Dealer=Bad Experience

It's not how it should be. It's just how it is.

Can you elaborate on the pros and cons of this. Customer care said they could start the buyback process and if approved I would get an offer. From what you said, I assume invoking the lemon law would work differently. Thanks much.
