I don't think the guy was going to stick around if you wouldn't have jumped out of your truck.

It doesn't appear the guy even slowed down, probably fucking around on his phone.
He was on his way out for sure. I have a Blackvue in every car and truck I own. I won't drive without one to be honest

Retired LEO here, the state of law enforcement at this time is generally pitiful. Many jurisdictions are not arresting misdemeanor crimes. And many felonies go unprosecuted. You should have an advocate acting on your behalf, since you and your passengers are victims. The police should be providing a service to you. Glad you were in a truck, it protected you all somewhat. Sending wishes for a quick recovery.

@TeamCanada not the same in the States... You can still be liable for an accident even if you are DUI... In fact it would help in a civil lawsuit (if necessary) because it shows the at-fault driver's negligence.

Went out into the city for Dinner tonight and got rear ended. Complete stop at a red-light and get blasted from behind by a crackhead in a jeep. Not even joking about the crackhead part. Bedside destroyed as well as Rear bumper. Hopefully the frames okay. Going to take to body shop on Monday. Trucks the easy part. Wife's back is hurting pretty bad so we wil see how this goes.

My car got rear ended at a stop light in NJ by a crackhead. I saw the car behind me slowly creeping up to me in the rear view mirror and the guy was passed out on the steering wheel and I had nowhere to go. He eventually woke up. I had a couple small divets from the screws in his license plate so didn't bother making an insurance claim.

If someone had been transported to the hospital in an ambulance, you would have forced the LEO's hand into an investigation.

Years of investigating accidents have taught me how to handle them to receive the desired outcome.

They found the guy at his house drunk after he fled, decided nobody gets tickets and it’s a no fault. The guy worked for OSHA, the irony.

That may be the case where you live. It is not true where I live.
This happened in Philadelphia. I live in Delaware County. If this happened where I live he would have been arrested. The car would have been impounded. No questions asked. Almost makes me not wanna come into the city to spend my hard earned money anymore.

That sucks. I just had to say though... There are WAY more complications to those types of cases than most people think.

Proving DUI, at the time of driving, can be very difficult when the driver flees and is later located at home. The strategy for their defense attorney will be to argue that: 1. You can't prove they were driving, and 2. That they weren't drunk when the accident occurred, but rather, they went home and got drunk there. It takes quite a bit of evidence to overcome that "reasonable doubt". Evidence like video from the scene, multiple witnesses, a confession from the driver, alcohol containers in the car, or receipts in the suspect;s vehicle from a bar, restaurant, or liquor store, etc... those all help. One way of getting proof of intoxication is doing "retrograde extrapolation" on a suspect's blood or breath sample. This requires, first, that they consent to performing the test, and second, (for the best accuracy) that three tests are done over 1-hour intervals, in order to establish the "slope" of the individual's metabolization rate, which then indicates whether the suspect's intoxication level is increasing or decreasing and at what rate. This "rate" can then be used to back up to the time of the accident in order to determine the approximate intoxication "level" at the time of the accident. Crude (and inaccurate) retrograde extrapolation relies on just one test of a suspect's blood or breath and then using a "standard metabolization rate" of .015 per hour.

And, in the scenario of a hit-and-run, there is also the issue of proving who was behind the wheel of the car. If you didn't see the driver, and nobody else saw the driver, then it is hard to identify them afterwards. Law enforcement can go contact the registered owner, and they can (and often do) refuse to answer the door, claim their car was stolen (usually abandon it somewhere), remain silent, or just refuse to answer any questions (constitutional rights). It is then up to physical evidence to prove someone was the driver. Evidence like injuries on the suspect's face, hands, arms, etc., suspect's cell-phone geo-location records, surveillance cameras where the suspect lives showing them driving home, statements from other resident's at the house, etc.

Sorry for your bad luck and hope your wife heals up quickly! If it got into the bed sides, they will have to put it on the frame rack to check it out. It will then show up on Carfax as "frame damage" and you will have diminished value issues. Ask me how I know this...

I just litigated it myself, I got my hands on a run list (sold list) from Manheim I searched several sales throughout Canada, I found 2 - 2018 - F-150 King Ranch trucks that were comparable and had like mileage, fortunately I found one with a carfax with a $25,000.00 hit like mine had verses the clean carfax one I found several of these through the different trim levels, the judge ruled that the average difference if $6,500.00 from a hit vehicle to a clean vehicle, that's what I got, I even asked for costs for this action and got n additional $1,000.00. 😀

Glad your wife is better. Sorry about the wreck.
When I got ceramic, I asked what would happen if I got hit. He said they deal with that all the time, just get it fixed as normal and then bring it in to get reapplied, and insurance covers the loss.

So, I'd really like to replace my front and rear bumpers with heavy steel ones to help add some mass for collisions. I don't know if that's the right thinking or if it would even help. I know MPG will go down, but it feels like most pickups with a big heavy bumper sure fare better than those without. Our vehicles are made to crumple and disintegrate in a controlled way, and I appreciate all that R&D. BUT then I see this guy that hit you and I think "Okay the tweaker should have taken all the damage, and none for me" and I'd sleep well every night knowing that's how it played out (if it went like that.. frame damage is a pita)

Back in 2005 I got showered in rocks from a failed tailgate latch on a gravel truck, I was driving my 04 Sonic Blue SVT Lightning, as you can imagine my paint job was done. I had that protection package put on the truck for the paint and upholstery, when it came time to get the truck fixed Intact Insurance took care of the body work and paint bill no problem, I asked about the paint protection an shower them it was applied from new as I had the proof in the file folder, they basically told me to go piss up a rope, the wording on the insurance policy says they will repair it to "pre accident condition", well guess what I did, sued, and lost. The Judge ruled that Intact Insurance fulfilled their end of the Insurance policy, as far as the Insurance Company and Judge was concerned, I was conned in to paying for a real expensive wax job. Being I was all of maybe 25 years old at this time they were going to teach me a lesson, they did. I got held for Intacts legal bill and Court costs for a total of almost $4,000.00. I got an education that day.
