2021 LARIAT Sport delivered with wrong spec

Hi All,
Like the title says, my 2021 Lariat Sport was delivered with the wrong spec rear end and the dealer isn't being very helpful...
I ordered this thing last November and I just took delivery last week - the entire purchase was done online and I never set foot in the dealership - they even delivered it tp my house. I was all happy with my new truck until I looked at the window sticker and it showed 3.15 open rear end vs the 3.55 elec. locking rear end that I ordered. I immediately contacted my sales rep and told him of the mistake, and he went to work trying to find out whose mistake it was. So far, it seems that's all the dealership is concerned with. I want the truck I ordered not, the one they sent me. Does anyone know if I have any recourse here, can I sue them or something if they don't fix their mistake? or am I screwed because it's sitting in my driveway?

If you signed papers it's probably yours and you're screwed unless your state law has an exemption or something. Florida has a 3 day grace period on vehicle purchases or something like that

I’m not an attorney, but this is America, so you can absolutely sue them. Is it worth it? No, probably not. The dealer should rectify the situation, but may not because you accepted the truck. They are going to say you had ample time to review the window sticker and/or order sheet before the truck was delivered.

Here is the 'not worth it' part: you could add an Eaton E-Locker and gears for less than it would cost you to sue the dealer. I am sorry this happened to you, but I would pursue the dealer until your blue in the face and bring proof that this is their mistake (something you signed showing the correct specs). I think you can get this fixed without legal help, but you may have to work for it and run it up the chain of command.

Do you have an email back & forth with the dealership of a spec'd out build sheet you approved prior to order? Not sure what the legal implications are, but I'd imagine it'd at least help with the dealership.
I ordered mine through a similar process, basically over email & phone. I sent the dealership a PDF of the specific build I put together on Ford's site & we went back & forth a couple times until everything on the build sheet he produced looked good. I sent an approval email to order the one with those exact specs at that price.
When the dealership emailed me a few weeks later with the VIN it's a damn good thing I checked on the VIN tracker. My custom built SQ King Ranch showed up as a red Lariat with my name on it. I immediately contacted the dealership & they contacted the Ford rep who said it got screwed up in the system somewhere. If I hadn't caught it, there's a good chance I'd lose my mind when I show up this week to pick it up. Like everything these days, the customer really has to advocate for themselves from beginning to end.

This is a pretty big goof on your dealers part. I just ran thru the build site and the Lariat comes with the 3.55 rear standard on every trim level. Someone would have had to specifically choose that option during the order process. Seems a little suspect and like maybe someone was trying to pad the bottom line.

It actually doesn’t. Mine didn’t show up as the 3.55 on my order until I went back and had the dealer change the order so I had the Max Trailer Tow Package (which I ended up deciding that I wanted).

Sorry for you situation. Hopefully the dealership does the right thing. They probably won’t have trouble finding someone else who wants the truck.

It would seem to me that the dealer would have or should have sent you the detailed order for your sign-off before placing the order.

And upon delivery sign-off, you should have inspected the vehicle, including all paperwork, window sticker, etc, to ensure everything was correct before accepting it.

Mistakes do happen, but there should have been at least two opportunities to have caught it before accepting vehicle.

I do have LOTS of emails and texts detailing this very issue, I wanted to get the max trailer pkg but I was informed that there was delays with the max package so, I agreed to take the 3.55 axle but they ordered the 3:15 open differential instead. This could get ugly...

If you both agreed via email that it was supposed to have a 3.55 rear end prior to it being ordered, then yes, the dealer should definitely be doing something to rectify the issue. If they offered you an "incoming unit" to avoid the wait of an order and sent you the build sheet that said 3.15, then it's not as black-and-white.

Wonder if you could find something close enough to your original order that you would accept and near you, and then have them essentially do a dealer trade with that dealer.

At least they seem to be open to getting this rectified. I would give them every chance to fix this, especially if you have documentation on your side. They can sell that truck...

Thanks for the replies, I am trying to work with the dealer but they aren't really trying to work with me. I literally have not driven or even moved this thing since it was dropped off in my driveway. They still have a "new" fully loaded Lariat supercab that they can get full price for. I would like to buy from the same dealer but I am not afraid to go somewhere else.
Does anyone know if there's a FORD customer service department or something I can reach out to?
